The Bay Area Air Quality Management District (BAAQMD) has passed Regulation 9, Rule 6, requiring all new residential water heaters to meet a zero-NOx (nitrogen oxide) emissions standard. Starting January 1, 2027, this applies to standard residential water heaters under 75,000 BTU. Furnaces follow in 2029, and larger commercial units come later.

Here’s the part most people miss: you do NOT have to rip out a working gas water heater. If yours is running fine, keep using it. The rule kicks in at the point of sale and installation — meaning once your unit breaks down or needs replacing after the effective date, its replacement will need to be a zero-emission option like an electric or heat pump water heater.
